SMS Messaging Program Terms

LendingXpress SMS Messaging Program

LendingXpress is a direct lending brokerage firm which uses this SMS messaging program to communicate with customers who have inquired, opted-in and agreed to receive text message communication from LendingXpress. This program enables two-way communication between our customers and loan officers for faster, more convenient service.

Description of SMS Use Cases

Our SMS messaging program is used for the following specific purposes:

  1. Customer Service and Support: Our loan officers use SMS to respond to your questions about our lending products, eligibility requirements, loan terms, and application process. You can text us questions and receive prompt responses to help you make informed decisions about your loan options.
  2. Application Status Updates: We send you real-time text notifications about the progress of your loan application, including when we receive your application, when it’s under review, when additional information is needed, when a decision is made, and when your loan is approved or ready for closing.
  3. Document Requests and Confirmations: We text you to request additional documentation needed for your loan application (such as pay stubs, bank statements, tax returns, or identification) and send confirmations when we successfully receive your documents.
  4. Appointment Reminders and Scheduling: We send SMS reminders for scheduled phone calls, video meetings, or in-person appointments with our loan officers. We also allow you to request, confirm, reschedule, or cancel appointments via text message.
  5. Important Account Notifications: We alert you via SMS about critical account information, including changes to your loan terms, payment due dates, payment confirmations, missed payment alerts, and important account security notifications.
  6. Two-Way Communication with Loan Officers: Our SMS program allows you to communicate directly with your assigned loan officer via text message. You can ask questions, provide updates, share information, and receive personalized assistance throughout the loan process.
  7. Identity Verification and Security Alerts: We may send you one-time verification codes (OTP) via SMS to verify your identity when accessing your account or making important changes. We also send security alerts if we detect unusual activity on your account.
  8. Promotional Offers and Special Lending Programs: With your consent, we send occasional promotional text messages about special interest rates, new loan products, refinancing opportunities, and limited-time offers. You will receive no more than 4 promotional messages per month.

Message Frequency: The number of messages you receive will vary based on your loan application activity and your interactions with our team. During active loan application periods, you may receive up to 10 messages per month. During inactive periods, you may receive fewer messages or only promotional offers (maximum 4 per month).

How to Opt-In

By providing your mobile phone number through our website form, loan application, or any contact form and checking the box indicating consent to receive SMS messages, you are providing your express written consent to receive recurring text messages from LendingXpress. Your submission of the form with your mobile number and checked consent box constitutes your electronic signature agreeing to receive text messages from us.

Opt-in is not required: Consent to receive SMS messages is not a condition of purchasing any goods or services from LendingXpress. You may still apply for and receive loans without opting into SMS communications, though you may not receive timely updates about your application.

Opt-Out Instructions

You can cancel the SMS service at any time. To stop receiving messages:

  • Text “STOP”, “END”, “CANCEL”, “UNSUBSCRIBE”, or “QUIT” to the shortcode or phone number from which you received messages
  • Upon sending your opt-out request, we will send you one final SMS message confirming that you have been unsubscribed
  • Following this confirmation, you will no longer receive any SMS messages from us
  • To rejoin the program, sign up again as you did initially by providing your mobile number and consent through our website

Support Hours: Monday through Friday, 9:00 AM to 6:00 PM EST. Messages sent outside business hours will be responded to on the next business day.

Message and Data Rate Disclosure

You are responsible for all charges from your mobile carrier. Message and data rates may apply to all SMS messages sent to you from us and to us from you. The charges depend on your mobile carrier’s text messaging plan.

Standard Carrier Charges Apply:

  • Standard text messaging rates from your wireless carrier will apply to all messages sent and received
  • Data charges from your wireless carrier may apply if messages contain links, images, or multimedia content
  • The exact cost per message depends on your individual mobile service plan
  • If you have an unlimited text messaging plan, messages will typically be included at no additional charge
  • If you have a limited text messaging plan, each message sent and received will count against your plan’s allotment
  • If you do not have a text messaging plan or exceed your plan limits, your carrier may charge per-message fees

Message Frequency and Estimated Costs:

  • You may receive up to 10 messages per month during active loan application periods
  • Promotional messages will not exceed 4 messages per month
  • If your carrier charges $0.20 per text message and you receive 10 messages per month, your monthly cost could be approximately $2.00
  • Additional messages may be sent if you initiate conversations with our loan officers

Check with Your Carrier: For complete information about your specific text plan, message rates, data charges, and any applicable fees, please contact your wireless service provider directly or review your mobile service agreement.

International Messaging: International text messaging rates may be significantly higher. If you are traveling internationally or using an international phone number, check with your carrier about international SMS rates before opting into our program.

Carrier Liability Disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

Message delivery is subject to effective transmission from your wireless service provider’s network. Delivery and receipt of SMS messages depends on factors outside of our control, and we cannot guarantee that messages will be delivered or delivered in a timely manner. Factors that may affect message delivery include:

  • Network Congestion: High network traffic may delay message delivery
  • Technical Issues: Carrier system outages, maintenance, or technical problems may prevent delivery
  • Phone Settings: Your phone’s settings, spam filters, or text blocking features may block messages
  • Phone Status: If your phone is turned off, out of service area, or in airplane mode, messages may be delayed or not delivered
  • Storage Limitations: If your phone’s message storage is full, new messages may not be received
  • Carrier Filtering: Some carriers filter or block messages they identify as spam or promotional
  • Number Changes: If you change your phone number without notifying us, messages will not be delivered
  • International Roaming: SMS delivery may be unreliable when roaming internationally

No Liability: LendingXpress and participating wireless carriers are not liable for any delays in the receipt of, or failure to deliver, any SMS messages. Neither LendingXpress nor any participating carriers shall be liable for any undelivered, delayed, or misdirected messages, or for any damages resulting from such delivery issues.

User Responsibility: It is your responsibility to ensure that:

  • Your phone is capable of receiving SMS messages
  • Your phone number is current and active
  • You notify us if you change your phone number
  • Your phone has adequate signal strength and network coverage

  • And other participating carriers

Age Restriction (18+)

You must be at least 18 years of age to participate in our SMS messaging program and use our services. By opting into SMS communications, you represent and warrant that you are at least 18 years old.

For loan applications, you must be at least 18 years old to apply. However, if you are under the age of 21, you may not be eligible for certain loan products depending on state laws and our lending criteria.

All images, text, graphic designs, and template structures on our website are protected under the Digital Millennium Copyright Act (DMCA). Under no circumstances may anyone reproduce, transmit, or store on any computer, media card, media disc, illustrations, images, or working drawings, for any length of time without having prior written approval from LendingXpress.

Customers may view and print documents from our website so long as you use them for non-commercial purposes and do not post, distribute, or modify in any way, such as, but not limited to, watermarks. Diagrams and images throughout our website have digital signatures in them to verify originality and ownership. Action will be taken against any person or persons, company, and/or companies involved in the unauthorized use of said images and publications.

If you see a photo and/or photos on other websites that are the same as ours, that image was illegally obtained by the offending company and/or person. Please notify us of any copyright infringement.

Information Collection

We do not collect any personally identifiable information about you unless you specifically give it to us. However, the fact that you visited us may be tracked for statistical purposes, but not in a way that can be used to personally identify you. We may log your domain such as “yahoo.com” or “bing.com” (not your email address), when your visit occurred and its duration, and the pages you visited. We collect this information to measure how our site is being used so we can improve its content.

Personal Information You Provide to Us

We DO NOT sell, rent, or share your personal information with any other person or company for any reason that is not directly related to our services or products. When you submit a request for contact, we will need your name, address, and contact information. We will then contact you for the purpose of providing the information or assistance you requested.
